Conditions of participation in games, competitions and prize draws

THE FOLLOWING CONDITIONS OF PARTICIPATION FORM THE BASIS FOR PARTICIPATING IN GAMES, COMPETITIONS, PRIZE DRAWS AND THE FREE PURCHASE OF GOODS (INCLUDING SAMPLE SETS) – HEREINAFTER REFERRED TO AS “PROMOTION” – AT COFFEEB.

PARTICIPANTS MUST BE AGED 18 OR OVER. 

THESE CONDITIONS OF PARTICIPATION APPLY TO PARTICIPANTS RESIDING IN SWITZERLAND. A THOROUGH KNOWLEDGE OF THESE CONDITIONS OF PARTICIPATION IS NECESSARY, AS PARTICIPATION IN A "PROMOTION" INVOLVES ACCEPTANCE OF THESE CONDITIONS OF PARTICIPATION. PARTICIPATION IS NOT POSSIBLE IF THESE CONDITIONS OF PARTICIPATION ARE NOT AGREED TO.

2. Right of participation

All persons residing in Switzerland who have reached the age of 18 are eligible to participate. Employees of the agencies Serviceplan Suisse, plan.net, TMC Reisen, Coffee Circle and the competition organiser as well as their direct family members are excluded from participation. Employees of lottery associations, automated services and other professional/commercial participants are also excluded from participation.

Only one entry per person is possible and only with correct information. The competition organiser reserves the right to exclude participants from the “promotion” who provide a pseudonym or a false identity and who register for the draw multiple times.


3. No purchase requirement

Participation in the “promotion” does not require any purchase. Please refer to the call for tenders for the respective “promotion” to find out how to participate free of charge.


4. Access for participation

Participation in the “promotion” is only possible online by e-mail.


5. Regulation of prizes

An agency commissioned by the organiser will arrange the delivery of the prizes. Exact details of the agency contact person will be sent by the organiser together with the prize notification.

If necessary, or in the event of an incident beyond the control of the organiser, the organiser reserves the right to replace part or all of the prizes with another prize (or prizes) of equal or higher value.

No cash alternatives to the prize or any other form of compensation will be paid. The prize cannot be transferred to third parties.


6. Disclaimer

The organiser is not liable for prizes that do not reach the winner due to events beyond the organiser’s control or incorrect information provided by the participant. Participants are required to provide correct information.

The organiser is not liable for the use of any non-organiser network, computer, material or program or any failure of these items to operate which may restrict or delay participation or delivery of the prize.

The organiser and its affiliated companies are not liable for:

a) rescheduling or cancellation of the competition due to events beyond the control of the organiser;

b) any modification, offer or use of the prize by third parties; 

c) any action or negligence on the part of an external supplier. 

In addition, liability is generally excluded for all incidents outside the circumstances for which the organiser is responsible. 


7. Expiry of the prize

If a winner is unable to accept their prize, regardless of the reason, the prize will expire. The prize will expire also if the prize cannot be delivered within the deadline of 3 months after the draw or if the winner cannot be contacted within such deadline.


8. Fraudulent participation

Fraud, the use of a fictitious name or the name of a third party, as well as any false, illegible, invalid or incomplete information on the entry form and any breach of these conditions of participation will result in the immediate exclusion of the participant from the “promotion”.


9. No recourse to legal action

There is no right of appeal. No correspondence will be entered into concerning the competition, except with the winners.


10. Use of data

The organiser will only use the personal data of the participants for the purposes and processing of the “promotion” in accordance with the consent given by the participants

By entering this competition, participants consent to the storage, filtering, access, processing and disclosure of data to third-party partners of the organiser for the purpose of managing the competition, as well as to the use by the organiser of the information provided in the course of entering the competition for the aforementioned purpose. The participant must submit a written statement to the organiser in order to exercise the right of inspection, rectification and objection.

The organiser has the right (but not the obligation) to use the name of the winner of the first prize in an anonymous form (for example Michel D. from Bern) as part of the promotion on the CoffeeB website and Facebook page.


11. Cancellation, modification or rescheduling of the “promotion”

The organiser is entitled to make adjustments at any time and to suspend, cancel or end the competition prematurely in the event of force majeure, closure/shutdown of websites/applications, manipulation by third parties/participants, technical failure or other important reasons.


12. Jurisdiction

The “promotion” and any dispute or claim arising out of or in connection with it is governed by applicable Swiss law. By participating, the participant accepts the exclusive jurisdiction of the Swiss courts for any legal disputes or claims arising from or in connection with the competition. 


13. Exceptions

Exceptions to one or more points of the aforementioned conditions of participation are possible within the framework of certain “promotions” if they are explicitly mentioned in this way in the description of the specific “promotion”.
